Flat-fee pricing applies when both parties agree on the terms and will sign the required documents. Texas requires a statutory waiting period, so an agreed divorce typically completes in about 61 days.

Cases With Children: When Mediation May Be Required

Flat-fee cases assume the standard Texas guidelines for child support, conservatorship (legal decision-making), and possession/access (the parenting schedule). If your agreement differs substantially from those guidelines, the court may require mediation before it will approve your order. Mediation can be added at the rate shown under Common Add-Ons.

When it's contested

If Your Spouse Won't Sign (Service of Process)

If your spouse will not sign, we must formally deliver the paperwork to them — this is called service of process. Costs depend on where they are located and are added to your flat fee. If they are served and still do not respond, we can finish the case by default (without their participation).

Contested / Served Divorce (Retainers)

When a divorce is served or contested, we work from a retainer billed against our hourly rates. Payment plans are available — a typical down payment is shown for each.

QDRO Pricing

A Qualified Domestic Relations Order (QDRO) divides an employer retirement plan such as a 401(k) or pension. IRAs do not require a QDRO.

Divorce by Publication (Spouse Can't Be Found)

When a spouse cannot be located, we proceed by publication. These cases are handled hourly statewide and often take several months to a year.

FAQs

How much does an uncontested divorce cost?
An agreed (uncontested) divorce with no children is a $999 flat fee, and with children it is $1,999. Both include up to three property transfers and all attorney and paralegal time for the agreed scope.
What if our terms are not standard?
Flat fees assume the Texas presumptions for support, conservatorship, and possession. If your terms deviate substantially, the court may require mediation, which is available as an add-on.
What is the difference between a QDRO add-on and a stand-alone QDRO?
A QDRO prepared as part of your agreed divorce is $600. A stand-alone QDRO petition — filed when the divorce is already final or handled separately — is $3,000 per case statewide.
What happens if my spouse won't sign?
We formally serve your spouse. Service is +$1,000 in Texas, +$1,500 out of state, and from $2,000 in a foreign country. If they still do not respond, we can proceed by default.
Do you handle matters outside Harris and Fort Bend counties?
Yes. Uncontested matters outside Harris and Fort Bend add $250. Contested retainers outside those counties are $7,500 instead of $5,000.
Is the consultation really free?
An in-office consultation is free, Monday through Friday, 8:30 a.m. to 4:00 p.m. Phone consultations are $100 for 30 minutes and evening Zoom consultations are $250.
How much does a contested case cost?
Contested and served divorces work from a retainer — $5,000 in Harris and Fort Bend, or $7,500 elsewhere — billed against our hourly rates. Payment plans are available.
What are your hourly rates?
Michael G. Busby, Jr. bills at $510 per hour, associate attorneys at $450, and paralegals at $175–$270. Law clerks, legal assistants, and office clerks bill at lower rates.
What does a trial or appeal cost?
A bench trial is $10,000 due 30 days before trial; a jury trial set within 60 days is $25,000 with half upfront. Appeal briefs start at a $5,000 minimum retainer, plus court costs paid by the client.

We can divorce by publication. Without children it is $3,000 total; with children or property it is a $4,000 retainer. The court may also set an attorney ad litem fee of roughly $1,500–$2,000.
