A divorce is contested when the spouses disagree on one or more material issues — typically property division, child custody, child or spousal support, or grounds for divorce. Any unresolved issue at the time of filing makes the case contested, even if other issues are agreed.
How is community property divided in a Texas contested divorce?
Texas is a community-property state. Assets and debts acquired during the marriage are presumed community and divided in a manner the court deems "just and right" — not automatically 50/50. Separate property (owned before marriage, or received by gift or inheritance) remains with the original owner if properly traced.
Will my contested divorce go to trial?
Most Texas contested divorces resolve through mediation before trial — Harris County courts typically require mediation before setting a final hearing. We prepare every case as if it will be tried, which strengthens your position whether you settle or proceed to a judge or jury.
Can I get spousal maintenance (alimony) in Texas?
